Regulations

1. General provisions

These regulations are intended to ensure you a peaceful and comfortable holiday.

The regulations set out the rules and conditions under which bookings are made and the properties listed on the CARISMA website are rented.

Making a booking is equivalent to accepting the provisions of these regulations.

The Agreement is concluded at the moment the booking is made by e-mail, in person at the CARISMA office or by phone.

All payments are accepted exclusively in Euro.

2. Booking an apartment or a house

A booking of an apartment or a house with CARISMA requires payment into the indicated bank account of a deposit amounting to 30% of the total rental cost.

A booking may be made in person at the Carisma office, by phone or online;

The Tenant is obliged to send confirmation of the deposit payment to the bank account.

A legible proof of payment in the form of an electronic transfer confirmation generated from the online banking service is considered a valid payment document.

Payment of the remaining 70% must be made no later than 30 days before the first day of the stay. The contract between Carisma and the client is concluded at the moment the payment is credited to the Carisma account.

In the case of a booking made less than 30 days before the first day of the stay, the full amount is payable immediately and its payment means the conclusion of the contract.

If the client does not make the payment within 3 days of making the booking, Carisma reserves the right to dispose of the property freely, i.e. to book it for another client.

At check-in a refundable security deposit of EUR 2,000 for a house / EUR 300 for an apartment is collected.

Failure to pay for the stay in advance entitles the person appointed to contact the Guest to refuse accommodation and the handing over of the key to the apartment or house.

Please keep and bring with you a copy of the advance payment made earlier.

If the booking has to be cancelled, the amount paid by the client is refunded immediately after receipt of a written instruction containing the bank account number, less the cancellation costs (contractual penalty). The cancellation costs are (in total):

An amount equal to a percentage of the booking value - depending on the date the cancellation is reported (number of days before the beginning of the stay) according to the following scale:

  • 31 days or more - full refund of the deposit
  • 30 days or less - the deposit is non-refundable
  • The day of cancellation is deemed to be the day on which the client notified us of the cancellation of the booking

Carisma policy in the case of late arrivals: Guests arriving between 22:00 and 07:00 are obliged to pay a surcharge of EUR 50. This fee is collected by the person responsible for handing over the keys, at check-in at the property.

3. Rental agreement, terms and scope

The agreement concluded between CARISMA and the Client renting an apartment or a house covers the rental of the property only. Meals, transport to the property and the organisation of time during the stay remain solely the Client's responsibility.

The Client should arrive at the time agreed with the person responsible for handing over the keys.

The Client is obliged to inform the Office by e-mail (24 hours a day) or by phone (during office hours 10:00 - 18:00) of the planned arrival time no later than 48 hours before the beginning of the booking period.

The rental day in the apartment / house starts at 16:00 and ends at 10:00. Earlier access to the property is possible if it has been cleaned and prepared to receive Guests (by individual arrangement with the CARISMA office).

The meeting with the representative and the handing over of the keys take place at the rented property.

When the keys to the property are collected, CARISMA reserves the right to verify the Guests' identity.

The number of people staying in the apartment / house may not exceed the number of people declared when booking. If this number is exceeded, the Landlord reserves the right to terminate the Agreement with immediate effect.

The Tenant is obliged to take proper care of the rented property.

When handing over the keys, the representative gives instructions on the operation of the electrical appliances that are part of the equipment of the property. This moment also constitutes familiarisation with the technical condition and the inventory of the apartment / house and of the appliances in it.

The Client is obliged to inform the person responsible for handing over the keys immediately of any damage or missing items found at the property, and to report any damage caused during the stay.

Failure to report comments and objections regarding the technical condition at the moment of moving into the apartment / house means that the apartment / house was handed over in a condition that raised no comments or objections from the Guest.

CARISMA employees have no right to enter the rented property without the Tenant's permission, subject to the right of entry in the case of a safety hazard or of Guests failing to comply with these regulations.

It is forbidden to use any electrically or gas-powered appliances which are not part of the equipment of the property and which may cause a fire hazard, e.g. electric heaters, radiators, gas burners.

It is forbidden to burn candles, to bring flammable materials into the apartment / house, and to burn explosive materials or materials with an unpleasant smell.

Smoking is completely prohibited in the apartments and houses available on the CARISMA website; smoking is allowed on balconies, terraces and outside the building. CARISMA reserves the right to impose a penalty of EUR 150 in the case of failure to comply with the smoking ban at the properties.

Travel and stay insurance is arranged by the Tenant on their own.

Every time the apartment / house is left, the Tenant is obliged to switch off the air conditioning and the electrical appliances, turn off the water and close the doors and windows of the property carefully.

It is strictly forbidden to remove from the property any items that are part of its equipment, such as towels, blankets, pillows, appliances, furniture, etc.

A Guest who intentionally or accidentally damages the property of the apartment or house is obliged to cover the resulting costs in full. CARISMA reserves the right to decide on the manner of compensation for the damaged property.

Moving furniture in the apartments and houses is prohibited.

In the case of loss of the keys to the property, Guests are obliged to pay a fee of EUR 100 - EUR 200.

Clients are obliged to keep the property in proper order and to observe the rules of good neighbourhood, in particular to observe quiet hours between 22:00 and 6:00.

Before finally leaving the property, the persons renting it are obliged to leave the dishes washed, to empty the fridge and to take out the rubbish. This range of activities is not included in the final cleaning.

On the day of departure the Tenant is obliged to make the rented apartment or house available to the person appointed for service in order to check the condition of the property. Only then does the Guest have the right to leave the apartment / house.

Invoices for the stay are issued at the Client's request.

CARISMA reserves the right to refuse to hand over the keys if the Guest: does not have a valid identity document, is under the influence of alcohol and/or drugs, or behaves aggressively.

In some properties it is possible to stay with a pet.
Please check this possibility by phone, by e-mail or in the property description. The additional fee for a pet is EUR 10 per day.

CARISMA is not liable for items left at the property by the Tenant.

CARISMA reserves the right to change the property for another one of the same or a higher standard, in the case of unforeseen circumstances and fortuitous events beyond CARISMA's control which make the proper use of the apartment / house impossible.

CARISMA is not liable for inconveniences and fortuitous events beyond our control related, for example, to renovations or construction works on the premises of the building, the estate or in its vicinity, noise, disturbance of the peace by neighbours, or interruptions in the supply of utilities occurring during the tenant's stay in our properties.

All enquiries and comments are accepted exclusively during the Office working hours, from Monday to Friday between 10:00 and 18:00.

Please note! In Spain, door handles are usually fitted only on the inside of the door. If the tenants lock themselves out of the apartment / house and a locksmith has to be called, the cost of the service depends on the type of lock and ranges from EUR 180 to EUR 380.

Any claims regarding possible damage or missing equipment verified by CARISMA staff upon return of the apartment or house will be pursued in court.

All additional services are settled according to the price list.

If satellite or cable television is indicated in the description, this does not automatically mean that all desired channels will be available. The owners of the houses, being of various nationalities, have decoders which do not always receive all international channels.

Accidents and theft

Neither CARISMA nor the owner of the property is liable for any damage or loss (injury, illness, death, material damage or theft) suffered by the guest or the persons accompanying them during the stay. By making a booking, the guest assumes responsibility for their own personal safety and the safety of their belongings and releases CARISMA and the owner of the villa from any liability for them. In order to minimise potential risks, please take particular care when using the kitchen and the swimming pool, as these are the areas of the property that involve additional risk for guests, and make sure that all doors and windows of the property are properly closed. These recommendations are especially important when children and/or elderly people are among the guests.

The contractual relationship is governed by Spanish law, and any disputes or claims that may arise between the parties in connection with the stay in our villas will be settled by the courts of Denia (Alicante).

CARISMA Immobilien S.L. processes personal data in order to respond to the requests submitted. You may exercise your right of access, rectification, erasure and portability of your data, as well as the restriction of and objection to its processing, and also the right not to be subject to decisions based solely on automated data processing, where applicable, by sending an e-mail to the address indicated.

This data will be processed with full guarantee of confidentiality and in accordance with the provisions of Act 2/2023 of 20 February.

Finally, we inform you of the right to lodge a complaint with the competent supervisory authority for data protection, in particular with the Spanish Data Protection Agency https://www.agpd.es/portalwebAGPD/index-ides-idphp.php.
